Uniforms and Badges Act

Uniforms
A  set of distinctive clothing worn by members of a particular group, an organization, corporation or a union as a means of identification during execution  of their duties.
Badges
means any token, design and crest, armorial bearings, insignia or emblem, which can be applied to any article or uniform for the pattern, shape, configuration or ornamentation thereof.

 

There are certain acts which are prohibited by law with respect to usage of names, uniforms, badges, and armorial bearings. Offences occur were any person —

(a) Contravenes subsection (1) of section three of the Armorial Bearings, Names, Uniforms and Badges Act [Chapter 10:01];

(b) without the authorization of the association concerned, uses a name or buys or uses a uniform or badge
which has been registered in terms of section fifteen knowing that he required such authorization;

(c) without the authorization of the person concerned, uses a heraldic representation which has been registered in terms of section fifteen knowing that he required such authorization; or

(d) uses a name, uniform, badge or heraldic representation which so closely resembles a name, uniform,
badge or heraldic representation registered in terms of section fifteen as might lead to the belief that such
unregistered name, uniform, badge or heraldic representation is the name, uniform, badge or heraldic
representation so registered, knowing that such registered name, uniform, badge or heraldic representation
has been so registered

(e) sells, barters or otherwise disposes of a uniform or badge which has been registered in terms of section
fifteen to any person who to his knowledge is not authorized to use or buy such uniform or badge by the
association concerned

(f) sells, barters or otherwise disposes of a uniform or badge which so closely resembles a uniform or badge
registered in terms of section fifteen as might lead to the belief that such unregistered uniform or badge
is the uniform or badge so registered, knowing that such registered uniform or badge has been so registered.

 

Importance of Uniforms and Badges

  1. Uniforms & their insignia differentiate one organization from another.
  2. They are an essential component of corporate identity and branding. They distinguish corporate people from the crowd.
  3. Uniforms, in the service sectors, like banking and communications, are used to show prestige.
  4. In the public service, they easily identify servants who are needed in times of need, for example, soldiers, policemen, health workers, doctors and other officials.
  5. Insignia on an appropriate uniform identifies a person of authority and rank, for instance a major from a captain.
